Key Points

  • Loretta Alvarez, a 26-year-old single mum and mental health nurse, was fined £1,000 by Hounslow Council for leaving an envelope next to full communal bins in Feltham.
  • The bins are shared by around 25 properties and often fill up before weekly collection. Alvarez placed the envelope on top of existing cardboard waste.
  • Alvarez says she was “stressed” and “shocked” by the fine and cannot afford to pay it, fearing repercussions on her employment and criminal record.
  • Hounslow Council threatened legal action if the fine was not paid by 5 November, warning of possible criminal charges.
  • The council doubled down on the fine, stating littering includes leaving waste anywhere other than in a bin, regardless of bin capacity.
  • Councillor Pritam Grewal emphasised a zero-tolerance approach to littering and fly-tipping, citing the cost burden on local taxpayers.
  • Alvarez argues the council should improve bin facilities and suggests she is being unfairly targeted, especially given more serious fly-tipping incidents in the area.
  • The Local Democracy Reporting Service (LDRS) reported that Hounslow Council briefly put the fine on hold but has not cancelled it, and refused Alvarez’s request to set up a payment plan.

What Happened to Loretta Alvarez in West London?

Loretta Alvarez, a 26-year-old single mother and mental health nurse living in Feltham, West London, found herself facing a £1,000 fine issued by Hounslow Council for what officials described as “fly-tipping.” The offence stemmed from her placing an envelope just beside overflowing communal bins serving approximately 25 properties. Alvarez explained to the Local Democracy Reporting Service (LDRS) that the bins had been full, so she laid the cardboard envelope on top of other discarded cardboard near the bins.

Alvarez said,

“I’m a single mum working as a mental health nurse. I pay all my rent, council tax and bills; I can’t afford to pay that. I would never intentionally do that.”

She also described the experience as “so stressful,” saying she has been trying to manage the situation alongside her work and parenting responsibilities.

Why Did Hounslow Council Issue the £1,000 Fine?

Hounslow Council delivered the fine after discovering the envelope bearing details identifying Alvarez next to the full bins. As reported by the Evening Standard, the council initially gave Alvarez until Wednesday, 5 November, to pay the fine in full under threat of legal action, including potential criminal charges. Alvarez missed the deadline, stating she simply does not have the money to comply.

Council Cabinet Member for Community Safety, Customer Experience and Enforcement, Councillor Pritam Grewal, told the Standard,

“We remain committed to taking a zero-tolerance approach to littering and protecting the local environment. We are clear that we have done the right thing in dealing with this, and issuing the fine, because littering includes leaving waste anywhere in public apart from in a bin, regardless of whether bins are full.”

The councillor added,

“While we accept that no one likes receiving a fine, residents expect us to tackle the offence and the offenders. As well as making our streets look neglected, it is not fair that Hounslow Council’s taxpayers have to foot the bill for littering and fly-tipping. Such costs could be spent on delivering vital services for our residents.”

How Has Loretta Alvarez Responded to the Fine?

Alvarez maintained that the bins she shares with over two dozen households only get emptied once a week and are frequently full. She believes the council should provide better waste disposal facilities for tenants. She remarked,

“It does feel like they are targeting me. It’s Christmas coming up, I don’t have £1,000 lying around, not many people do, there are more important things they should be dealing with than an envelope.”

She emphasised that she apologises if her action was considered littering but contrasted her situation with more serious fly-tipping offences in the area, noting,

“I’ve seen people dumping cabinets – that’s fly tipping, this isn’t.”

Alvarez also expressed concern about the impact of the fine on her career.

“I’m a mental health nurse, I went to university for three years… they’re fining me more than someone gets for speeding,”

she said to LDRS. She worried the fine and potential criminal charges could affect future employment and DBS (Disclosure and Barring Service) checks.

Did the Council Consider Loretta Alvarez’s Circumstances?

According to Alvarez, when she visited the council offices to resolve the issue, she initially struggled to find an environmental officer. Eventually, a council officer was found who acknowledged that photographic evidence showed the bins were full at the time. Alvarez said the officer told her the council does consider personal circumstances, yet insisted that “everyone has to be treated equally,” and the fine must be paid.

Alvarez also requested a payment plan to manage the fine in installments, but the council refused.

As reported by LDRS following inquiries, Hounslow Council put the fine “on hold” for further review but did not cancel it and subsequently reaffirmed the fine.

What Does This Incident Reveal About Local Waste Management in Feltham?

Alvarez’s case highlights ongoing challenges in communal waste management in Feltham, where shared bins often reach capacity before scheduled collections. The incident raises questions about whether the current number and size of bins is adequate for the volume of waste produced by residents.

During the reporter’s visit accompanying LDRS, discarded household items, such as dumped bags and a fridge, were spotted nearby, contrasting with Alvarez’s discreet placement of an envelope.

Why Is This Case Causing Public Debate?

The case has garnered attention for its apparent severity in relation to the offence and the individual circumstances of Alvarez, who is a working single mother and health professional. It touches on broader issues about councils’ enforcement policies, fairness in issuing fines, and the balance between environmental protection and compassionate treatment of residents.

Council’s insistence on a strict, uniform approach to littering offences contrasts sharply with Alvarez’s claim that the fine is disproportionate and that the local waste service falls short for residents.

What Are the Next Steps in Loretta Alvarez’s Case?

As of now, Alvarez has not paid the fine and faces possible legal action from Hounslow Council, which has warned of criminal charges if the fine remains unpaid. The council confirmed it remains committed to enforcing littering laws strictly, despite the financial difficulties cited by Alvarez.

The outcome will hinge on whether Alvarez can negotiate a resolution with the council or if enforcement proceeds to court.
